Child Custody & Visitation – Under New York law, the courts order a temporary custody order during the initial separation of spouses. Upon divorce, the marital agreement will include both a physical placement order and a legal custody order.

Child Support & Maintenance – Under New York law, child support can be ordered immediately upon separation, and is always part of the marital agreement of a divorce. Spousal maintenance is also available in most situations. Often times, people need an attorney who can handle support orders immediately so that they can continue to work and provide for their children.

Adoption – Fero & Caputo helps parents with the many legal hurdles involved in both domestic and international adoptions, as well as stepparent adoptions.

Fero & Caputo will prepare any type of marital agreement, including prenuptial agreements, postnuptial agreements, and marital property settlement agreements that protect your rights and your assets.

Preparation of Wills – We can prepare individual wills and mirror wills (for married / cohabiting couples) tailored to your individual requirements. It is especially important to make a will if you own property or have children, so you can make the necessary arrangements in the event of your death. Failure to make a will means that you will die intestate and your estate will be divided between individuals in the order prescribed by law.

Powers of Attorney – A Power of Attorney is a legally binding document whereby you appoint someone to deal with your property and affairs during your lifetime. An Enduring Power of Attorney is as above but the power to act as Attorney only comes into force if you lose your mental capacity.

Probate and Administration of Estates – If you are the executor of someone who has died, we can obtain a Grant of Probate / Letters of Administration on your behalf and can also assist with the administration of the estate if so required.
